These Terms of Service ("Terms") govern your use of the LingTutor mobile application ("LingTutor," the "App"), provided by MTD Technology Company Limited ("MTD," "we," "us," or "our"), operating under the brand Tarunow. By downloading, installing, or using LingTutor, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

LingTutor is a language-learning application that provides lessons, vocabulary flashcards, spaced-repetition review, level placement, daily goals, and related learning features. LingTutor is an educational tool intended to help you learn and practice a new language.

LingTutor does not require an account. Your learning progress is stored locally on your device.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use LingTutor. By using the App, you represent that you meet this requirement.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use LingTutor for your personal, non-commercial learning purposes, subject to these Terms and the rules of the app store from which you obtained the App.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse engineer or attempt to extract the source code, except where permitted by law.
• Use the App in any unlawful way or to infringe the rights of others.
• Interfere with or disrupt the App or its supporting infrastructure.

4. Educational Purpose and No Guarantee of Results

LingTutor is provided for educational and self-improvement purposes only. While LingTutor is designed using established learning methods such as spaced repetition and active recall, we do not guarantee any specific outcome, including any particular level of language proficiency, exam result, job outcome, or professional result. Your progress depends on many factors, including your own effort and consistency.

LingTutor is not a substitute for formal education, certification, or professional language instruction where such is required.

5. Advertising and Future Paid Features

The App is supported by advertising provided through Google AdMob. By using the free version of the App, you agree that we and our advertising partners may display ads as described in our Privacy Policy.

Future versions of LingTutor may offer optional in-app purchases or subscriptions for additional features or to remove ads. Any such purchases will be subject to additional terms presented at the time of purchase and to the billing terms of the app store through which you make the purchase. Pricing, availability, and features may change.

6. User Content and Conduct

LingTutor stores your learning data locally on your device. You are responsible for any content you create within the App and for maintaining your own device and backups. We are not responsible for loss of locally stored data resulting from device loss, damage, app deletion, or device changes.

7. Intellectual Property

The App and all of its content — including text, lessons, audio, graphics, the LingTutor name and logo, the mascot, and software — are owned by or licensed to MTD and are protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.

8. Third-Party Services

LingTutor integrates third-party services, including Google AdMob, Firebase Analytics, and Firebase Crashlytics. Your use of these services is also subject to the relevant third party's terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT IS ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MTD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) US$50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable law, including certain consumer rights in the EU/UK.

11. Indemnification

You agree to indemnify and hold harmless MTD and its affiliates from any claims, damages, losses, and expenses arising out of your misuse of the App or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or for any lawful reason. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts of Singapore, except that either party may seek injunctive relief in any court of competent jurisdiction.

For disputes exceeding US$10,000, the parties may agree to resolve the dispute by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its rules.

Nothing in this section deprives consumers in the EU, UK, or other regions of mandatory protections or the right to bring claims in their local courts where such rights cannot be waived.

14. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where required, provide additional notice. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
