Terms of Service

1. The Service

Fliq is a photo and video editing app. It lets you crop and adjust photos, apply filters, retouch, remove backgrounds, add text and stickers, build collages, and turn your photos into short videos using built-in templates. Some versions of the App also offer AI-based features, covered by section 6.4.

Fliq does not require an account. Your photos, projects and settings are stored locally on your device.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use Fliq. By using the App, you represent that you meet this requirement.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Fliq, subject to these Terms and the rules of the app store from which you obtained the App.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App itself.
• Reverse engineer or attempt to extract the source code, except where permitted by law.
• Use the App in any unlawful way or to infringe the rights of others.
• Interfere with or disrupt the App or its supporting infrastructure.

4. No Guarantee of Results

The App is offered "as is" and we do not guarantee any specific outcome or result from using it, including the visual quality of an edit, an export, or an AI-generated result. AI output in particular is probabilistic: it may be inaccurate, unflattering, or not what you expected, and it may differ between runs with the same input.

5. Advertising and Future Paid Features

Versions of the App that include advertising are supported by ads provided through Google AdMob. Where that applies, you agree that we and our advertising partners may display ads as described in our Privacy Policy.

Future versions of Fliq may offer optional in-app purchases or subscriptions for additional features, for credits used by AI-based features, or to remove ads. Any such purchases will be subject to additional terms presented at the time of purchase and to the billing terms of the app store through which you make the purchase. Pricing, availability, and features may change. Refunds are handled by the app store under its own policies.

6. User Content and Conduct

6.1 Your photos and your output

You keep all rights to the photos you bring into Fliq and to the images and videos you create with it.

You may use what you create for any lawful purpose, including commercial use — selling products, promoting a business, publishing on social platforms — subject to two things: you must hold the necessary rights in the underlying photos, and you must respect the license terms of any template, sticker, font, or music asset included in your result. The assets bundled with Fliq are licensed to you for use inside images and videos you create with the App; they may not be extracted and redistributed on their own.

6.2 Your responsibilities

You are responsible for the content you create. Do not use Fliq to produce material that is unlawful, that infringes someone else's rights, or that depicts a person in a way they have not agreed to.

6.3 Local storage and backups

Fliq stores your projects, drafts and settings on your device. You are responsible for maintaining your own device and your own backups. We are not responsible for loss of locally stored data resulting from device loss, damage, app deletion, storage cleanup, or device changes.

6.4 AI-based features

Where the App offers a feature that produces a result using artificial intelligence, the following applies in addition to the rest of these Terms:

• Your photo is processed off your device. The photo you submit is sent to a processing provider that runs the model. Section 3.3 of the Privacy Policy explains what happens to it and how long it is kept.
• You must have the rights to what you submit. Do not submit photos of other people without their permission, and do not submit photos you do not have the right to use.
• Prohibited uses. You may not use AI-based features to create sexual content, content depicting minors inappropriately, content that impersonates a real person in a misleading way, content intended to deceive or defraud, or content that promotes violence, hatred, or self-harm. We may block requests and suspend access to these features where we detect such use.
• Results are marked as AI-generated. Output from these features is labeled in the App and carries machine-readable provenance information in the exported file. You agree not to remove or obscure that labeling.
• Reporting. The App provides a way to report generated content you consider offensive or inappropriate. We use those reports to improve filtering.

7. Intellectual Property

The App and all of its content — including text, graphics, templates, stickers, fonts, bundled music, the Fliq name and logo, and software — are owned by or licensed to MTD and are protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.

8. Third-Party Services

Fliq integrates third-party services, including Google Play services, Google ML Kit, Firebase Analytics, and Firebase Crashlytics; Google AdMob in versions that include advertising; and AI processing providers where the App offers AI-based features. Your use of these services is also subject to the relevant third party's terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT IS ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MTD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) US$50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable law, including certain consumer rights in the EU/UK.

11. Indemnification

You agree to indemnify and hold harmless MTD and its affiliates from any claims, damages, losses, and expenses arising out of your misuse of the App, your violation of these Terms or applicable law, or your infringement of a third party's rights through content you create or submit.

12. Termination

We may suspend or terminate your access to the App, or to specific features such as AI-based features, at any time if you violate these Terms or for any lawful reason. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts of Singapore, except that either party may seek injunctive relief in any court of competent jurisdiction.

For disputes exceeding US$10,000, the parties may agree to resolve the dispute by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its rules.

Nothing in this section deprives consumers in the EU, UK, or other regions of mandatory protections or the right to bring claims in their local courts where such rights cannot be waived.

14. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where required, provide additional notice. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
