Terms of Service

Welcome to Cardia: Blood Pressure & Sugar ("Cardia" or the "App"). These Terms of Service (the "Terms") form a legal agreement between you (the "User" or "you") and MTD Technology Company Limited ("we," "us," "our," or "Tarunow").

By downloading, installing, or using Cardia, you agree to these Terms. If you do not agree, please do not use the App.

Please read these Terms carefully. Sections you should pay particular attention to are Section 4 (Medical disclaimer), Section 10 (Disclaimers and limitation of liability), and Section 14 (Governing law and dispute resolution).


1. About us and the service

What Cardia is: Cardia is a personal wellness logbook for the Android platform that lets you record and review your blood pressure, blood sugar, and heart rate readings. Cardia stores your readings locally on your device, classifies them against published wellness guidelines, and displays trends and reminders to support your day-to-day self-tracking.

What Cardia is not: Cardia is not a medical device. It does not diagnose, treat, cure, or prevent any disease, and it is not a substitute for professional medical care. See Section 4.


2. Eligibility

You may use Cardia only if all of the following are true:

Regional age requirements: If you are located in India, the Digital Personal Data Protection Act 2023 treats anyone under 18 as a child requiring verifiable parental consent. If you are under 18 and in India, you should use Cardia only with the involvement of a parent or guardian.

If you do not meet these eligibility requirements, please do not use the App.


3. Your account (and what happens without one)

Cardia today does not require you to create an account. Your readings and settings are stored locally on your device. There is no login, no password, and no server-side profile.

Future accounts: We may introduce optional account creation, cloud sync, and related features in the future. If we do, you will be asked to accept additional terms specific to those features before they are enabled. Until then, your use of Cardia is entirely device-based.

You are responsible for safeguarding access to your device. If you lose your device or someone else uses it, they will have access to the readings stored in Cardia.


4. Medical disclaimer (please read this carefully)

4.1 Cardia is a wellness tool, not a medical device

Cardia is a wellness and lifestyle logbook intended for general informational purposes only. Cardia is not a medical device and has not been evaluated or cleared by the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), Vietnam's Ministry of Health, India's Central Drugs Standard Control Organization (CDSCO), or any other regulatory authority.

4.2 Zone classifications are reference information only

The zone classifications shown in Cardia (for example: normal / elevated / high blood pressure under the ACC/AHA 2017 or ESC/ESH 2018 guidelines; normal / prediabetes / diabetes ranges under the WHO/IDF criteria; heart rate ranges) are based on published medical guidelines as of the App's release date. These classifications are provided for general informational purposes only and may not reflect the most current guidelines, regional variations, or your individual medical context. Always consult a qualified healthcare professional to interpret your readings.

4.3 Camera-based heart rate measurement is an estimate

Cardia offers an optional photoplethysmography (PPG) feature that uses your device's camera to estimate your pulse rate. This feature is an estimate for general wellness purposes only. Accuracy can be affected by lighting, finger placement, motion, skin tone, device camera quality, and other factors. The PPG feature is not a medical-grade measurement and must not be used for the diagnosis, treatment, or management of any cardiac or other health condition. If you need an accurate heart rate measurement, please use a properly calibrated medical device or consult a qualified healthcare professional.

4.4 In a medical emergency

If you believe you are experiencing a medical emergency, immediately call your local emergency number (911 in the United States, 112 in the European Union, 102 or 108 in India, 115 in Vietnam, or the equivalent in your country) or visit the nearest emergency department.

Do not rely on Cardia for emergency response. Cardia does not monitor you continuously, does not alert emergency services, and is not designed for emergency use.

4.5 Your responsibility

You are solely responsible for how you use, interpret, and act on the information Cardia displays. Do not delay, avoid, or disregard professional medical advice because of anything you read or see in the App. If you have a chronic condition, are taking medication, are pregnant, or have any other health concern, consult your healthcare provider before relying on Cardia in any way that affects your care.


5. License to use Cardia

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use Cardia on a compatible Android device that you own or control, solely for your personal, non-commercial wellness tracking. This license is subject to your compliance with these Terms.

We retain all rights, title, and interest in and to Cardia, including all intellectual property rights. Nothing in these Terms transfers any ownership to you.

7. Your content and data

7.1 The readings you enter

The blood pressure, blood sugar, heart rate, tags, notes, and other information you enter into Cardia are your data. We do not claim ownership of it. As described in our Privacy Policy, this data is stored locally on your device and is not transmitted to our servers.

7.2 You are responsible for accuracy

You are responsible for the accuracy of the data you enter. Cardia processes the values you provide; it cannot verify whether a reading is correct, whether you took the measurement properly, or whether your measurement device is calibrated. Garbage in, garbage out applies — incorrect inputs lead to incorrect classifications and trends.

7.3 Backup your data

Because your data is stored locally, you are responsible for backing it up if you wish to preserve it. If you uninstall Cardia, clear its data through Android settings, lose your device, or factory-reset your device, your readings will be permanently lost and cannot be recovered by us.


8. Third-party services

Cardia uses third-party services to function, including:

Your use of these services through Cardia is also subject to their respective terms and privacy policies. We do not control these third parties and are not responsible for their acts or omissions. Please review their terms:

The App is distributed through the Google Play Store, and your installation of the App is also subject to Google Play's terms of service.


9. Advertising

Cardia is free to download and use, and is funded by advertising provided through Google AdMob. By using Cardia you acknowledge that ads will be displayed in the App. We do our best to keep the ad experience reasonable and non-disruptive, but we do not control which specific ads are shown to you. If you encounter an ad that violates Google's ad policies, you can report it directly through the ad's settings menu (the three-dot icon on most AdMob ads).

We may introduce an optional ad-free subscription or other paid features in the future. If we do, additional terms specific to those purchases will apply at the time of purchase and will be subject to Google Play's billing policies.


10. Disclaimers and limitation of liability

10.1 The App is provided "as is"

To the maximum extent permitted by applicable law, Cardia is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, including but not limited to:

10.2 Limitation of liability

To the maximum extent permitted by applicable law, in no event shall MTD Technology Company Limited, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for:

arising out of or related to your use of (or inability to use) Cardia, even if we have been advised of the possibility of such damages.

Aggregate cap: Our total cumulative liability to you for all claims arising out of or related to these Terms or your use of Cardia shall not exceed the greater of (a) fifty US dollars (US$50) or (b) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

10.3 Mandatory consumer protections

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, you may have rights that override the disclaimers and limitations in this Section 10. Where this is the case, those rights prevail to the extent required by law, and the rest of these Terms continues to apply.


11. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless MTD Technology Company Limited and its affiliates, officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:


12. Updates and changes

12.1 Updates to the App

We may release updates, patches, or new versions of Cardia from time to time. Some updates may be installed automatically through the Google Play Store. We may also discontinue features, modify functionality, or change the App's behavior at any time without prior notice, except where required by law.

12.2 Changes to these Terms

We may revise these Terms from time to time. When we do:

Your continued use of Cardia after a Terms update means you accept the updated Terms. If you do not accept the updated Terms, you must stop using Cardia.


13. Termination

13.1 Termination by you

You may stop using Cardia at any time. To fully terminate your use, uninstall the App from your device. Doing so will permanently delete the readings stored locally in Cardia.

13.2 Termination by us

We may suspend, restrict, or terminate your access to Cardia (in whole or in part) at any time, with or without notice, if:

Upon termination, the license granted in Section 5 ends immediately. The following sections survive termination: Section 4 (Medical disclaimer), Section 7 (Your content and data), Section 10 (Disclaimers and limitation of liability), Section 11 (Indemnification), Section 14 (Governing law and dispute resolution), and any other provision that by its nature should survive.


14. Governing law and dispute resolution

14.1 Governing law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14.2 Disputes — courts

Subject to Section 14.3, any dispute, claim, or controversy arising out of or related to these Terms or your use of Cardia shall be subject to the exclusive jurisdiction of the courts of Singapore.

14.3 Optional arbitration (at our election)

For any dispute where the amount in controversy exceeds US$10,000, we may elect to resolve the dispute by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its rules then in force. The seat of arbitration shall be Singapore, the language shall be English, and the tribunal shall consist of a single arbitrator. The arbitration award shall be final and binding on the parties.

14.4 Mandatory consumer rights

If you are a consumer protected by the mandatory laws of your country of residence (for example, in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protections), you may also be entitled to bring proceedings in the courts of your country of residence, and to rely on the consumer protection laws of that country. Nothing in this Section 14 deprives you of those rights.


15. General provisions

15.1 Entire agreement

These Terms, together with our Privacy Policy and any additional terms we present for specific features (such as future subscriptions or accounts), constitute the entire agreement between you and us regarding Cardia. They supersede any prior agreements between us on this subject.

15.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 No waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.

15.5 Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, network or power failures, or government action.

15.6 Headings and interpretation

Section headings are for reference only and do not affect interpretation. The word "including" means "including without limitation."

15.7 Language

These Terms are written in English. Any translation is provided for convenience only. If there is a conflict between the English version and a translation, the English version prevails.
